By using “The Card Shop: Greeting Card App” iOS/Android app you are agreeing to be bound by the following terms and conditions ("Terms of Use").
Please read these Terms of Service carefully as they contain important information regarding your legal rights, remedies and obligations.

Fees

You acknowledge that The Card Shop: Greeting Card App reserves the right to charge for Services and to change our fees from time to time in its discretion, upon posting such policy on the Service. Thereafter, upon using our Services, you will be responsible for the payment of any applicable fees as set forth on the Service.

Subscription Terms for The Card Shop App:

Subscribe to The Card Shop for $1.00 per 3 months all over the world.

Your The Card Shop subscriptions will automatically renew every 3 months and your credit card will be charged through your iTunes account. You can turn off auto-renew at any time from your iTunes account settings.

Your subscription will automatically renew each month and your credit card will be charged through your iTunes account. You can turn off auto-renew at any time from your iTunes account settings.

Subscriber's automatic renewal feature: Your subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period. Your iTunes account will automatically be charged at the same price for renewal within 24-hours prior to the end of the current monthly period unless you change your subscription preferences in your account settings.

You can manage your subscriptions through your Account Settings after purchase. No cancellation of the current subscription is allowed during active subscription period.

Eligibility and Credit Card Terms

To order any The Card Shop: Greeting Card App or other products, you must be at least eighteen (18) years of age or the applicable age of majority in your jurisdiction. You will be required to give us a valid credit card number (VISA, MasterCard, American Express or any other issuer then accepted by us) and associated payment information at the time you order The Card Shop: Greeting Card App or any other products here under, including all of the following:

- Your name as it appears on the card

- The credit card type

- The date of expiration of your credit card

- Billing address

- Any activation numbers or codes needed to charge your credit card.

The Card Shop: Greeting Card App does not accept cash, checks or any other payment form, although it reserves the right to change this policy in the future. Your credit card issuer agreement governs your use of your designated credit card, and you must refer to that agreement and not this Agreement to determine your rights and liabilities as a cardholder. You agree that no additional notice or consent is required before The Card Shop: Greeting Card App invoices the credit card for all amounts due and payable. By providing The Card Shop: Greeting Card App with your credit card number and associated payment information, you agree that The Card Shop: Greeting Card App is authorized to immediately invoice your account for all fees and charges due and payable to The Card Shop: Greeting Card App as a result of your purchase of any In-App Purchase or other products. You agree to immediately notify The Card Shop: Greeting Card App of any change in the credit card used for payment hereunder or in any associated information. The Card Shop: Greeting Card App reserves the right, at any time, to change its prices and billing methods for In-App Purchase and other products sold, either immediately upon posting on the Service or by e-mail delivery to you.

Fees and Charges

You agree to pay all fees and charges incurred in connection with your orders and purchases (including any taxes imposed on your orders and purchases, including, but not limited to, applicable sales, use or value-added taxes) at the rates in effect when the charges were incurred. Fees charged for goods and services may change at any time without advanced notice.

Proprietary Rights

All content on The Card Shop App, including but not limited to design, text, graphics, other files, and their selection and arrangement (the "Content") and all associated patent, trademark, service mark, trade dress, trade secret, copyright, and other intellectual property rights, are the property of The Card Shop: Greeting Card App or its licensors. All rights reserved. The Content may not be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without The Card Shop: Greeting Card App’s prior written permission under a separate agreement. You may download or print a copy of any portion of the Content solely for your personal, non-commercial use, provided that you keep all copyright or other proprietary notices intact. You may not republish Content on any Internet, Intranet or Extranet site or incorporate any of the Content in any other database or compilation. Any other use of the Content is strictly prohibited.

All trademarks, logos, trade dress and service marks on the Service are the sole property of The Card Shop: Greeting Card App or its licensors and may not be copied, imitated, or used, in whole or in part, without the prior written permission of The Card Shop: Greeting Card App under a separate agreement.

The technology and software underlying the Service or distributed in connection therewith is the property of The Card Shop: Greeting Card App (the “Software”). You agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right in the Software. Any rights not expressly granted herein are reserved by The Card Shop: Greeting Card App.

Member Content Posted on the Service

You are solely responsible for the content, text, information, photos, video, audio, images, graphics, or profile information that you publish or display (hereinafter, "post") on the Service, or transmit to other Members through the Service (collectively the "Member Content"). You understand and agree that The Card Shop: Greeting Card App may, but is not obligated to, review and delete or remove any Member Content that in the sole judgment of The Card Shop: Greeting Card App violates this Agreement or for any other reason.

By posting Member Content to any part of the Service, you hereby grant, and you represent and warrant that you have the right to grant, to The Card Shop: Greeting Card App an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, perform, display, modify, publish, reformat, translate, excerpt (in whole or in part) and distribute such Member Content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses to do the foregoing.

Copyright Policy

We respect the intellectual property rights of others. If you are a copyright owner or an agent thereof and believe that any Content or any material on the Service infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing (see 17 U.S.C. §512(c)(3) for further detail):

1. A physical or electronic signature of the owner of the right that is allegedly infringed or a person authorized to act on their behalf;

2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of the copyrighted works;

3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material on the Service;

4. Information reasonably sufficient to permit us to contact the owner or agent, such as an address, telephone number, and email address;

5. A statement that the owner or agent has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; that you are the owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Apple-Enabled Software Applications

The Card Shop: Greeting Card App offers Software applications that are intended to be operated in connection with products made commercially available by Apple Inc. (“Apple”), among other platforms. With respect to Software that is made available for your use in connection with an Apple-branded product (such Software, “Apple-Enabled Software”), in addition to the other terms and conditions set forth in these Terms of Service, the following terms and conditions apply:

- The Card Shop: Greeting Card App and you acknowledge that these Terms of Service are concluded between The Card Shop: Greeting Card App and you only, and not with Apple, and that as between The Card Shop: Greeting Card App and Apple, The Card Shop: Greeting Card App, not Apple, is solely responsible for the Apple-Enabled Software and the content thereof.

- You may not use the Apple-Enabled Software in any manner that is in violation of or inconsistent with the Usage Rules set forth for Apple-Enabled Software in, or otherwise be in conflict with, the App Store Terms of Service.

- Your license to use the Apple-Enabled Software is limited to a non-transferable license to use the Apple-Enabled Software on an iOS Product that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service.

- Apple has no obligation whatsoever to provide any maintenance or support services with respect to the Apple-Enabled Software.

- Apple is not responsible for any product warranties, whether express or implied by law. In the event of any failure of the Apple-Enabled Software to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Apple-Enabled Software to you, if any; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Apple-Enabled Software, or any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty, which will be The Card Shop: Greeting Card App’s sole responsibility, to the extent it cannot be disclaimed under applicable law.

- The Card Shop: Greeting Card App and you acknowledge that The Card Shop: Greeting Card App, not Apple, is responsible for addressing any claims of you or any third party relating to the Apple-Enabled Software or your possession and/or use of that Apple-Enabled Software, including, but not limited to: (i) product liability claims; (ii) any claim that the Apple-Enabled Software fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

- In the event of any third party claim that the Apple-Enabled Software or the end-user's possession and use of that Apple-Enabled Software infringes that third party's intellectual property rights, as between The Card Shop: Greeting Card App and Apple, The Card Shop: Greeting Card App, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

- You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

The Card Shop: Greeting Card App and you acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms of Service with respect to the Apple-Enable Software, and that, upon your acceptance of the terms and conditions of these Terms of Service, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Service against you with respect to the Apple-Enable Software as a third party beneficiary thereof.

Links to Other Web Sites

The Service contains links to other web sites. The Card Shop: Greeting Card App is not responsible for the content, accuracy or opinions expressed in such web sites, and such web sites are not investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked web site on the Service does not imply approval or endorsement of the linked web site by The Card Shop: Greeting Card App. If you decide to access these third-party web sites, you do so at your own risk.

Sharing on Social Networking Services

We may permit you log in to the Service via various online third party services, such as social media and social networking services like Facebook or Twitter (“Social Networking Services”), and we may ask you to authenticate, register for or log into Social Networking Services through their respective providers. As part of such integration, the Social Networking Services will provide us with access to certain information that you have provided to such Social Networking Services, and we will use, store and disclose such information in accordance with this Terms of Service. For more information about the implications of activating these Social Networking Services and The Card Shop: Greeting Card App’s use, storage and disclosure of information related to you and your use of such services within The Card Shop: Greeting Card App (including your friend lists and the like), please see our Privacy Policy. However, please remember that the manner in which Social Networking Services use, store and disclose your information is governed solely by the policies of such third parties, and The Card Shop: Greeting Card App shall have no liability or responsibility for the privacy practices or other actions of any third party site or service that may be enabled within the Service.

In addition, The Card Shop: Greeting Card App is not responsible for the accuracy, availability or reliability of any information, content, goods, data, opinions, advice or statements made available in connection with Social Networking Services. As such, The Card Shop: Greeting Card App is not liable for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Social Networking Services. The Card Shop: Greeting Card App enables these features merely as a convenience and the integration or inclusion of such features does not imply an endorsement or recommendation.

Privacy

The Card Shop: Greeting Card App cares about the privacy of its users. View Our Privacy Policy, which is incorporated into this Terms of Service.

Disclaimers

These Terms of Service constitute the entire agreement between you and The Card Shop: Greeting Card App regarding the use of the Service, superseding any prior agreements between you and The Card Shop: Greeting Card App relating to your use of the Service. The failure of The Card Shop: Greeting Card App to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. The Card Shop: Greeting Card App may assign its rights under this Agreement to any third party without notice or consent.
